BIDDER REGISTRATION

Standard clause istating the following rules for bidders:

1.    Age requirement: All bidders must be at least 18 years old.

2.    Account registration: Bidders must have a valid, current account registered on the website to participate in the auction.

3.    Gordoughs Garage’s discretion: The auction organizer, Gordoughs Garage, reserves the right to:

o   Suspend a bidder’s account at any time for any reason.

o   Cancel any bid for any reason.

This clause aims to ensure that only eligible and authorized individuals can participate in the auction, and that Gordoughs Garage has the flexibility to manage the auction process as needed.

PLACING A BID

Placing a bid on Gordoughs Garage is a legal contract. A clear and concise warning notice! It’s essential to highlight the importance of understanding the terms and conditions before placing a bid on Gordoughs Garage. 

Here’s a breakdown of the key points:

1.    No cancellations: Once a bid is placed, it’s considered a binding contract and cannot be cancelled.

2.    Acceptance of terms: By placing a bid, you agree to abide by all conditions and terms of use outlined by Gordoughs Garage.

3.    Dispute resolution: In the event of a dispute, the bidder agrees to cover any attorney fees and costs associated with collecting funds from Gordoughs Garage.

It’s crucial to carefully review the terms and conditions before placing a bid, as these clauses can have significant implications. By understanding these points, you can ensure that you’re aware of the risks and responsibilities involved in bidding on Gordoughs Garage.

EXTENDED BIDDING

Here’s a breakdown of how it works:

1.    5-minute extended bidding period: This means that the auction will continue to accept new bids for an additional 5 minutes after the initial
countdown timer reaches 1 minute.

2.    Trigger for extended bidding period: The extended bidding period is triggered when a bid is placed within the last minute of the auction countdown. This ensures that the auction remains active and allows for more bidding opportunities.

3.    Auction ends when no new bids are entered: Once the extended bidding period ends, the auction will continue to accept no new bids for a full 1 minute. If no new bids are entered during this time, the auction will end.

4.    Independent timers: Each auction has its own independent timer, which means that auctions will end at different times. This allows for a more dynamic and engaging bidding experience.

This feature helps to create a more exciting and competitive bidding environment, as bidders can place last-minute bids and try to outdo each other in the final moments of the auction.

 

RESERVE PRICES

This is a standard clause that you may find in auction terms and conditions. It’s a way to ensure that the seller (Gordoughs Garage) is willing to part with the item at a minimum price, known as the “Reserve Price”. This clause means that:

  • If the bidding does not meet or exceed the Reserve Price, the item will not be sold at the current auction.
  • The item may be relisted in a future auction at the discretion of Gordoughs Garage.
  • The seller has the right to decide whether or not to sell the item at the current auction and will only do so if the bidding meets or
    exceeds their minimum price.

This clause is intended to protect the seller from having to sell an item at a price that is too low, and to give them flexibility in determining when and how to sell their item.

 

PAYMENT

Payment terms:

  • Payment is due immediately upon completion of the auction.
  • The auction item(s) must be paid for in full within 24 hours.

Consequences for non-payment:

  • If the item(s) are not paid for in full within 24 hours, the item(s) shall be forfeited.
  • The bidder shall be responsible for a restocking fee equal to 30% of the Auction Invoice.
  • The restocking fee is assessed at the sole discretion of Gordoughs Garage.

This clearly outlines the expectations for payment and the consequences for non-payment. This policy is in place to avoid disputes and ensure a smooth transaction process.

SALES TAX

Winning bidders will be charged appropriate sales tax

SHIPPING

Auction Policies – All shipping costs will be paid by the winning bidder. Shipping is calculated by quantity, size and weight of the item(s) won as well as distance traveled from our location in CA. Items are processed and shipped within 3 business days of auction being paid in full. Gordoughs Garage is not responsible for the accuracy of your address.  

 

We will always ship to the most current shipping address on file on your account. If you have a different shipping address, you must change it on your My Account page. When you create an account and enter your address for shipping, that is the address that is utilized for shipping any item purchased from our website.

When tracking a package and USPS (or shipping company) states it has been delivered and you claim you did not receive it, we will NOT issue a refund or replace the item. A claim with USPS (or shipping company) will need to be filed.  We will assist in locating or file the claim when possible.

AUCTION CANCELLATION

This clause is known as a “cancellation clause” or “right to cancel” clause. It gives the auction organizer (in this case, Gordoughs Garage) the discretion to cancel an auction at any time, without notice or liability, for any reason. The purpose of this clause is to protect the auction organizer from potential legal disputes or complications that may arise during the auction process. By having this clause, the auction organizer can:

1.    Cancel an auction if there are technical issues or errors that prevent the auction from proceeding smoothly.

2.    Cancel an auction if there are concerns about the authenticity or legitimacy of the items being sold.

3.    Cancel an auction if there are issues with the bidder’s identity or payment information.

4.    Cancel an auction if there are unforeseen circumstances that make it impossible to continue with the auction.

It’s important for bidders to carefully review the terms of service before participating in an online auction, including the cancellation clause. This clause is not unique to Gordoughs Garage, and many online auction platforms and marketplaces have similar clauses in their terms of service.
